These Terms and Conditions of Use (“Terms”) govern your access to and purchase of the online workshop “Breathe. Reset. Repeat.” (the “Workshop”), offered by:

By purchasing or accessing the Workshop, you (“You”, “Your”) confirm that you have read, understood, and agree to these Terms. These Terms constitute a legally binding agreement between You and Breathe Sculpt Flow (“Company”, “We”, “Us”, “Our”).

These Terms are governed by German law and applicable European Union consumer protection legislation, including the EU Consumer Rights Directive (2011/83/EU) as implemented in German law (BGB).

1. ELIGIBILITY

You must be at least 18 years of age to purchase or access the Workshop. By completing a purchase, you confirm that you meet this age requirement. Access by minors is a violation of these Terms and We reserve the right to terminate access immediately upon discovery.

2. WORKSHOP DESCRIPTION

The Workshop is a 90-minute live online event focused on stress management, breathwork, and nervous system regulation for mothers. Each participant also receives one complimentary 60-minute private yoga and mindfulness session with Melissa Schuler, to be booked separately after the Workshop.

The Workshop price is inclusive of applicable VAT where required by law.

A recording of the Workshop will be made available to registered participants. Access details will be communicated via the email address provided at checkout.

3. PURCHASE AND PAYMENT

All payments are processed in Euros (€) via our third-party payment processors (e.g. Stripe, PayPal). By providing your payment details, you authorise Us to charge the total amount stated at checkout.

You agree to provide accurate and complete billing information. We reserve the right to cancel your registration if payment cannot be processed or if fraudulent activity is suspected.

Prices are inclusive of VAT where applicable under German/EU tax law. We reserve the right to correct pricing errors at any time; in such cases, you will be notified and given the option to proceed or receive a full refund.

4. RIGHT OF WITHDRAWAL AND REFUND POLICY

Statutory Right of Withdrawal (Widerrufsrecht)

Under EU and German consumer law (BGB § 312g, 355 ff.), consumers generally have a 14-day right of withdrawal from distance contracts without giving any reason.

However, pursuant to § 356 (5) BGB and Article 16(m) of the EU Consumer Rights Directive, the right of withdrawal expires before the end of the withdrawal period for contracts for the supply of digital content or online services if the performance has begun with the consumer’s prior express consent and acknowledgement that they thereby lose their right of withdrawal.

IMPORTANT — WAIVER OF WITHDRAWAL RIGHT

By completing your purchase, you expressly consent to the immediate commencement of the digital service (Workshop access and recording) and acknowledge that you thereby waive your statutory 14-day right of withdrawal once the Workshop has commenced or the recording has been made available to you.

This waiver will be confirmed to you in your purchase confirmation email.

No Refund Policy

Due to the digital nature of the Workshop and the immediate provision of access upon purchase, all sales are final. No refunds will be issued once access to the Workshop or its recording has been granted, except as required by mandatory applicable law.

If you are unable to attend the live Workshop, you will still receive access to the full recording. No partial refund or credit will be issued for non-attendance.

If a technical error on Our part prevents you from accessing the Workshop or recording entirely, please contact Us at [email protected] and We will make reasonable efforts to resolve the issue or, where appropriate, issue a refund at Our discretion.

5. INTELLECTUAL PROPERTY

All content provided as part of the Workshop — including but not limited to the workbook, recordings, slides, breath practices, movement sequences, written materials, and the Breathe Sculpt Flow name, logo, and brand assets — is the exclusive intellectual property of Melissa Schuler / Breathe Sculpt Flow, protected under German and EU copyright law (UrhG).

Upon purchase, you receive a limited, personal, non-transferable, non-exclusive licence to access and use the Workshop materials for your own personal use only. This licence does not permit:

Sharing, forwarding, or gifting your access to any other person
Reproducing, copying, or distributing Workshop materials in any form
Publishing or re-posting any content from the Workshop on social media or other platforms
Using Workshop materials for commercial purposes or in your own programmes or trainings
Modifying, adapting, or creating derivative works from any Workshop materials

Any unauthorised use constitutes copyright infringement and may be pursued under applicable civil and criminal law.

6. YOUR MATERIALS AND IMAGE

If you submit comments, photos, testimonials, or other materials on any platform associated with Breathe Sculpt Flow (including but not limited to email, social media, or online community platforms), you grant Us a non-exclusive, royalty-free licence to reproduce and publish such submissions for reasonable business purposes, unless you explicitly state otherwise at the time of submission.

We will always use your materials with care and in alignment with our brand values. You may withdraw consent for future use of your materials at any time by contacting Us in writing.

7. DISCLAIMERS

General Disclaimer

The Workshop is provided for educational and informational purposes only. The content shared does not constitute medical, psychological, therapeutic, or other professional advice. It is not a substitute for professional medical or mental health care.

We recommend that you consult a qualified healthcare professional before beginning any new movement, breathwork, or wellness practice, particularly if you are pregnant, postpartum, or have any pre-existing health conditions.

Individual results from the Workshop will vary. We make no guarantee as to the outcomes or effectiveness of the practices for any individual participant.

Technology Disclaimer

We make reasonable efforts to provide reliable access to the Workshop via reputable third-party platforms. However, We cannot be held liable for technological failures, interruptions, or issues caused by third-party providers, your internet connection, or circumstances outside Our control. In the event of a significant technical failure on Our part, We will make reasonable efforts to provide an alternative solution.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable German and EU law, We exclude liability for any indirect, incidental, or consequential loss or damage arising from your participation in the Workshop or use of its related materials.

Our liability for direct damages is limited to the amount you paid for the Workshop (€19). Nothing in these Terms excludes or limits liability for death or personal injury caused by Our negligence, fraud, or any other liability that cannot be excluded under mandatory applicable law (including consumer protection rights under German BGB and EU law).

9. DATA PROTECTION (GDPR)

We process your personal data (name, email address, payment information) in accordance with the EU General Data Protection Regulation (GDPR) and the German Bundesdatenschutzgesetz (BDSG). Your data is collected and processed solely for the purposes of processing your purchase, delivering the Workshop, and communicating with you about your participation.

We will not sell or share your personal data with third parties, except where necessary for payment processing or as required by law. For full details, please refer to Our Privacy Policy at yogawithmelissa.de.

You have the right to access, correct, delete, or port your personal data at any time by contacting Us at [EMAIL ADDRESS].

10. CONDUCT AND NON-DISPARAGEMENT

You agree to participate in the Workshop respectfully and in good faith. You agree not to make any false, misleading, defamatory, or malicious statements about Breathe Sculpt Flow, Melissa Schuler, or other Workshop participants.

We reserve the right to remove any participant from the Workshop (including live and community elements) without refund if their behaviour is deemed harmful, disrespectful, or in breach of these Terms.

11. DISPUTE RESOLUTION

In the event of a dispute, We encourage you to contact Us directly at [EMAIL ADDRESS] in the first instance. We will make every reasonable effort to reach an amicable resolution.

If a resolution cannot be reached by direct negotiation, you may have the right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings unless required by law.

These Terms are governed by the laws of the Federal Republic of Germany. Any legal proceedings shall be subject to the jurisdiction of the competent courts in Germany, without prejudice to mandatory consumer protection rights applicable in your country of residence within the EU.

12. CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. The current version will always be available at yogawithmelissa.de. Changes will not affect purchases already made prior to the update date.

13. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

These Terms, together with Our Privacy Policy, constitute the entire agreement between you and Breathe Sculpt Flow in relation to the Workshop.
